The Supreme Court’s immunity decision directed the trial court to hold hearings on what portions of the indictment can survive — a possible chance for prosecutors to set out their case in public before Election Day.

“With fear for our democracy, I dissent.” With these words, Justice Sonya Sotomayor concluded her dissent from the majority opinion in Trump v. U.S. She was joined by Justices Jackson and Kagan. She is right. In today’s decision, the conservative majority on the Supreme Court told us in no uncertain terms who they are, and I believe them. Their decision signals that they believe it’s more important to create a powerful presidency—

Today the United States Supreme Court overthrew the central premise of American democracy: that no one is above the law. It decided that the president of the United States, possibly the most powerful person on earth, has “absolute immunity” from criminal prosecution for crimes committed as part of the official acts at the core of presidential powers. The court also said it should be presumed that the president also has immunity for other official acts as well, unless that prosecution would not intrude on the authority of the executive branch.
